The teenager accused of aiding and abetting two other teenagers in the rape of a girl in a car at Limerick Races told gardaí that she offered to perform oral sex on all three of them that afternoon and did so.
The jury were presented with evidence of memos of interviews which gardaí had with the teenager accused of aiding and abetting and false imprisonment.
He said the girl was talking to his two co-accused at the racecourse and that the three of them walked away together and that he was a good bit behind them. He said he only went back to the parked car for his phone charger.
He told gardaí he was in the front seat and that the girl was sitting between the two boys in the back of the car.
Asked if he was surprised to see the girl in the car, he replied: “I was wondering what was going on.”
“She started kissing (13-year-old). Then they started kissing each other… I was on my phone in the front. (15-year-old) was on the other side. She stopped kissing (13-year-old) and started kissing (15-year-old) then,” he said.
The defendant said that the girl offered both boys in the back of the car to perform oral sex on them and they said yes and that she then performed oral sex on both of them. He said he was “just watching”.
He said he moved the car from where it was parked. Then it got a bit stuck and he moved it again to another part of the field car park. Asked why he moved it at all, he replied: “Don’t know. Cos I wanted to drive the car.”
He told gardaí that after the girl performed oral sex on both other boys she asked him did he want to have sex and he replied no, and that she then asked him if he wanted oral sex from her and he replied: "Fair enough".
One of the detectives said: “This is a girl you have never spoken to” and she was offering sex and oral sex.
Later in the interview a detective said that the complainant’s own evidence was that when she was leaving the car she was crying and looking for her friends. The defendant said: “She looked happy getting out of the car.” The prosecution is close to ending, senior counsel Dean Kelly said.
Mr Justice Paul McDermott said the trial could continue today even though another defendant (the boy who was 13 at the time of the alleged rape) was absent from the Central Criminal Court sitting in Cork.
The absent defendant, who was 13 at the time and is 15 now, and a co-accused who was 15 at the time and is now 17, are both charged with raping and sexually assaulting the teenager at a St Stephen’s Day 2022 race meeting at Limerick racecourse. A third boy is accused of aiding and abetting the first two defendants in carrying out these offences and he is also charged with falsely imprisoning the girl.
It is alleged that the contested incidents occurred in a car in a field car park at Limerick racecourse at Patrickswell, County Limerick, on December 26, 2023. All three accused have pleaded not guilty to the charges against them.
